Hostile Environment Liability Protection
Organizations operating in, or planning to operate in, complex and/or hostile environments need to be aware of the inherent risks and challenges. The extenuating circumstances in which they will have to work may well be fully understood by employees and clients alike, but this will not necessarily mitigate liabilities should an incident occur. This makes specialist liability insurance a necessity.
HELP provides access to an insurance program through a Lloyd's facility that is specifically designed for organizations operating in hostile environments. Coverages available include:
Coverage for bodily injury, property damage and/or financial loss resulting from the insured’s professional services, whether actual physical work or advisory consulting.
Coverage for bodily injury and property damage that could result from something as simple as a slip and fall in the office to accusations of unlawful injury or death to a third party while in (armed) defense of persons or property.
Coverage related to allegations of negligence in the standard of care provided by an employer. This is relevant where Defense Base Act cover is not applicable. Underlying Personal Accident, Sickness, on-site medical care, local evacuation and repatriation coverage should be purchased separately and be in place to fulfill duty of care responsibilities and mitigate employee lawsuits following sickness, injury or death.
Third Party Auto
Coverage for bodily injury and/or property damage to third parties resulting from use of a vehicle.
Coverage for failure to prevent transmission of viruses and other malicious code from computer systems to third party computers or systems. Errors and Omissions (E&O) in technology services provided to third parties whether as part of a broader service offering or as Risk Mitigation.
Infringement and Multi-media including Personal and Advertising Injury
Coverage for false arrest, detention, invasion of privacy, infringement of copyright, libel or slander of another person or organization, legal defense costs from lawsuits that claim false, malicious or misleading statements in advertisements, promotional materials or websites.
Coverage related to the responsibility of a merchant or manufacturer for products it manufactures, distributes or retails. If a defective product that was sold or manufactured causes a covered bodily injury or property damage, this coverage helps protect the merchant or manufacturer responsible for that product.
Human Asset Coverage
Duty of Care responsibilities require the arrangement of human asset insurances. Coverage recommended could include Personal Accident & Sickness, Life, Key Man, Medical & Security Evacuation plus insurance for the perils of kidnap, extortion, wrongful detention and hijacking. Kidnap & Ransom policies are indemnity policies that reimburse a loss by the insured business or individual.
Note that all coverages are the exclusive responsibility of the issuing Lloyd’s insurers and are subject to the terms, conditions, exclusions and limitations of the policy forms and endorsements, which shall in all cases control irrespective of the general descriptions of coverage provided above. Please consult your insurance professional as appropriate.
